3. Bookings and Availability
Submitting an inquiry or requesting a quote does not guarantee availability or reserve your event date.
An event is considered booked only after Freddy’s Ice Cream Catering has:
Confirmed availability;
Approved the event location and service requirements;
Received any required signed agreement;
Received the required deposit or payment; and
Issued written booking confirmation.
Freddy’s Ice Cream Catering may decline a booking request when:
The requested date or time is unavailable
The event location falls outside our service capabilities
Venue access is unsuitable
Setup conditions are unsafe
Required equipment or staff are unavailable
The requested menu cannot be provided
Event requirements are inconsistent with our services
Required agreements or payments are not completed
Availability remains subject to change until the booking process is completed.
4. Payments and Deposits
Payment terms, deposits, balances, due dates, and accepted payment methods may vary depending on:

Event date
Guest count
Service duration
Event location
Custom branding
Specialty products
Equipment requirements
Other booking details
Any required deposit and payment schedule will be shown in your proposal, invoice, or service agreement.
Failure to complete a required payment by the stated deadline may result in:

Removal of optional services
Cancellation of the booking
Unless otherwise stated in writing, an event date is not reserved until the required deposit has been received.
5. Cancellation and Rescheduling

Specialty toppings
Custom flavor labels
Signature sundae materials
Edible logo elements
Team apparel
Individually packaged products
Specialty dietary products
Once Freddy’s Ice Cream Catering has ordered, produced, printed, prepared, or committed to purchasing these items, the related costs may become nonrefundable.
The client is responsible for providing accurate artwork, colors, names, dates, trademarks, logos, and other custom information by the required deadline.
Freddy’s Ice Cream Catering is not responsible for errors contained in artwork or information approved by the client.
7. Client Responsibilities
The client is responsible for providing complete and accurate event information, including:
Venue name and address
Event date
Service start and end times
Estimated and final guest count
Loading instructions
Parking information
Stair or elevator access
Setup location
Indoor or outdoor conditions
Available electrical service
Venue rules
Building access requirements
Insurance requirements
Event contact information
Dietary or allergy-related requests
The client must notify Freddy’s Ice Cream Catering promptly if any information changes.
The client is also responsible for:
Obtaining venue approval
Providing reasonable access for setup and breakdown
Ensuring the service area is available at the agreed time
Obtaining permits required specifically from the event host or venue
Informing us of restrictions that may affect service
Providing a safe environment for our team
Preventing guests from entering restricted equipment or storage areas
Additional labor, waiting time, parking, access, or equipment costs caused by incomplete or inaccurate information may be added to the final invoice.
8. Setup and Venue Requirements
Freddy’s Ice Cream Catering generally requires a clean, level, safe, and accessible service area with enough space for:
The cart or serving display
Frozen-storage equipment
Freddy’s Scoop Hosts
Serving supplies
Guest ordering and pickup
Safe movement around the setup
Depending on the selected equipment, the venue may also need to provide:
Access to an approved electrical outlet
A dedicated electrical circuit
Safe cable placement
Suitable door and elevator clearance
Loading access
Nearby parking
Floor protection
Shade or weather protection
An indoor or covered backup location
Final requirements depend on the cart, menu, guest count, event location, and selected equipment.
The client must disclose stairs, narrow entrances, long loading routes, restricted elevators, security procedures, or other access challenges before booking.
If the service area is unsafe, inaccessible, or materially different from the information provided, Freddy’s Ice Cream Catering may adjust, delay, relocate, reduce, or decline service.
9. Outdoor Events and Weather
Outdoor service is subject to appropriate weather, venue access, equipment requirements, and food-safety conditions.
Outdoor events may require:
A level service surface
Shade
Protection from direct sunlight
Protection from rain, wind, or extreme weather
Safe access to power
An indoor or covered backup location
Denver and Colorado weather may change quickly. The client is responsible for providing an approved backup location when requested.
Freddy’s Ice Cream Catering may delay, modify, relocate, or stop service when weather or site conditions create a reasonable risk to:
Guests
Team members
Equipment
Products
Food safety
Venue property
Weather-related refunds, credits, and rescheduling are subject to the applicable Cancellation and Rescheduling Policy.
10. Guest Counts and Servings
The client must provide a final guest count by the deadline stated in the agreement.
The package will include a defined number of servings or product quantity. Freddy’s Ice Cream Catering does not guarantee unlimited servings unless that arrangement is expressly included in writing.
Changes to guest count may affect:
Pricing
Product quantity
Number of Scoop Hosts
Service time
Equipment
Menu availability
Number of service positions
If attendance exceeds the confirmed guest count, Freddy’s Ice Cream Catering may not have enough product or supplies to serve every additional guest.
Unused servings, unopened products, or remaining supplies are not automatically refundable.
Food products may not be released to the client after service when doing so would conflict with food-safety procedures, supplier requirements, or applicable regulations.

Freddy’s Ice Cream Catering may offer:

Professional Scoop Hosts
Cups and cones
Sundae bar catering
Pre-portioned service
Ice cream and sorbet selections
Dairy-free or vegan options when available
Toppings and sauces
Custom menus
Branded carts
Signature sundaes
Coffee and ice cream packages
Affogato service
Menu availability may vary based on:
Package
Event size
Supplier inventory
Season
Event location
Equipment
Service time
Dietary requests
Production deadlines
Freddy’s Ice Cream Catering may make reasonable substitutions when a selected product becomes unavailable.
When possible, we will notify the client and offer a comparable replacement.
Photographs and sample menus on the website are illustrative and do not guarantee that every displayed flavor, topping, product, decoration, or serving style is available for every event.
12. Food Allergies and Dietary Requests
Clients should disclose known dietary requests and food-allergy concerns before the menu is finalized.
Freddy’s Ice Cream Catering may provide available ingredient information and discuss options such as:
Sorbet
Dairy-free products
Vegan products
Individually packaged alternatives
Products made without certain ingredients
Freddy’s Ice Cream Catering is not an allergen-free environment.
Products, ingredients, toppings, utensils, carts, serving equipment, suppliers, commissaries, and partner facilities may handle common food allergens. Cross-contact may be possible.
Descriptions such as “dairy-free,” “vegan,” or “made without” a particular ingredient do not guarantee that a product is safe for a severe allergy.
The client is responsible for communicating relevant allergy information to guests and for determining whether a product or service arrangement is appropriate for an individual guest.
No allergy-related accommodation is confirmed unless it is included in the written event agreement.
13. Staffing and Service Speed
The number of Scoop Hosts assigned to an event is based on factors such as:
Guest count
Service duration
Menu complexity
Cups or cones
Toppings
Venue layout
Guest arrival pattern
Number of serving stations
Service-speed estimates are not guarantees.
Guest service may be affected by:
Large groups arriving at once
Complex orders
Extensive toppings
Venue restrictions
Delayed event schedules
Limited service space
Unplanned changes
Freddy’s Ice Cream Catering may recommend additional staffing, a simplified menu, pre-portioned products, or additional service stations for larger events.
Requests for a specific Scoop Host are not guaranteed unless confirmed in writing.
14. Event Delays and Overtime
The client must provide access to the venue and service area at the agreed time.
When service begins late because of venue access, event delays, client instructions, or circumstances outside Freddy’s Ice Cream Catering’s control, the scheduled end time may remain unchanged.
Additional service time is subject to:
Team availability
Product availability
Venue approval
Applicable overtime charges
Freddy’s Ice Cream Catering is not required to extend service beyond the agreed end time.
15. Parking, Travel, and Additional Expenses
The client is responsible for disclosing parking, valet, loading, toll, permit, and access requirements before the event.
Unless specifically included in the proposal, additional charges may apply for:
Paid parking
Valet
Tolls
Loading permits
Long-distance travel
Travel outside the primary service area
Overnight accommodations
Difficult loading routes
Extended waiting time
Venue-mandated labor
Special access requirements
When actual costs cannot be determined in advance, they may be invoiced after the event.
16. Damage and Guest Conduct
The client is responsible for damage to Freddy’s Ice Cream Catering equipment, carts, displays, serving materials, or property caused by:
Guests
Venue staff
Client representatives
Other vendors
Unauthorized movement or handling
Normal wear and tear is excluded.
Guests may not enter restricted service areas, operate equipment, move the cart, handle frozen-storage systems, or remove Freddy’s property without permission.
Freddy’s Ice Cream Catering may stop service when guest behavior creates a safety risk or threatens employees, contractors, equipment, or property.
Stopping service for unsafe conduct does not automatically entitle the client to a refund.
17. Photography and Event Media
Freddy’s Ice Cream Catering may request permission to photograph or record:

Products
Branding
Team members
Service setup
Event details
Any use of identifiable guest images will be subject to the permissions, venue policies, and event agreement applicable to the event.
The client must notify Freddy’s Ice Cream Catering before the event if photography, recording, social media posting, or public identification of the venue is restricted.
Client-provided logos, trademarks, artwork, or event materials remain the property of their respective owners.
The client grants Freddy’s Ice Cream Catering permission to reproduce approved materials only as reasonably necessary to fulfill the contracted service.

To the extent permitted by law, the client agrees to defend, indemnify, and hold harmless Freddy’s Ice Cream Catering and its owners, employees, contractors, and representatives from claims, damages, losses, liabilities, or expenses arising from:
False or incomplete information provided by the client
Venue violations
Client-provided branding or intellectual property
Guest misconduct
Unsafe event conditions controlled by the client or venue
The client’s violation of these Terms
The client’s violation of applicable law or third-party rights
This provision does not apply to the extent a claim results from Freddy’s Ice Cream Catering’s own unlawful conduct or liability that cannot legally be limited.

The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted by law.
27. No Waiver
A failure by Freddy’s Ice Cream Catering to enforce any provision of these Terms does not waive our right to enforce that provision later.
